Ronald Reagan, when asked about his strategy against the Soviet Union in the Cold War answered simply: “We win, they lose.”

The simplicity of this strategy struck the talking heads of the time as unsophisticated – even childish. Looking back at its brilliance, we see how it set a tone – a focal point – a direction for all to follow. The same simple principle holds true for litigation in estate & trust matters.

Winston Churchill said, “Attitude is a little thing that makes a big difference.” When it comes to estate, trust and probate litigation, attitude does make a big difference. Over my forty years of practice, I’ve seen lawyers who consistently expected to win – and their work, perseverance and creativity allowed them to win more often than not.

At Hackard Law we apply the “We Win, They Lose” strategy. This doesn’t mean that we always win 365 days a year, or that our attitude alone will save the day. It does mean that we expect to win – we expect that our enthusiasm, energy and experience will translate into a positive outcome. Our commitment to excellence shows.

We do not view ourselves as professors of the law who take only a dispassionate interest in the outcome of a case. We care about our clients, and we’re here to fight for our clients and protect them. No one hires us to be a law professor.

Charles R. Swindoll, the Chancellor of the Dallas Theological Seminary, says this about the importance of mindset:
